This document is an electronic record generated in full compliance with the Information Technology Act, 2000 (hereinafter referred to as the "IT Act"), the rules made thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

This electronic record is generated by a computer system and does not require any physical or digital signatures to have full binding legal effect. Under Section 10A of the Information Technology Act, 2000 and Section 2(h) of the Indian Contract Act, 1872, contracts formed through electronic communications, affirmative check-boxes, and computerized transaction confirmations constitute valid, binding, and enforceable contracts at law.

These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the website located at certify.elevatifier.com, elevatifier.com, and any associated subdomains, API endpoints, or services operated by Elevatifier Private Limited ("Elevatifier", "Company", "We", "Us", or "Our"). The terms "You", "Your", "User", "Applicant", or "Candidate" refer to any individual, student, or entity accessing the portal, completing certificate request forms, or paying for document generation services.

Elevatifier provides an automated, self-service technological platform that allows users to record, render, format, and host tamper-proof digital completion credentials, portfolio certificates, and internship recognition records with scannable cryptographic QR codes and persistent database registries.

Elevatifier disclaims any representation that its certificates automatically satisfy statutory degree requirements, government civil service eligibility, or mandatory public sector licensing examinations unless independently vetted and approved by the respective examining authority.

As an absolute condition of using this portal and paying for certificate generation, you hereby solemnly declare, warrant, and represent under penalty of perjury and applicable penal statutes:

1. Absolute Truthfulness of Information: You affirm that your legal name, institution/college affiliation, selected domain of training, starting date, completion date, and duration entered into the issuance portal are 100% truthful, accurate, and completely free of any falsehood, exaggeration, or deceptive embellishment.
2. Genuine Completion & Authorization: You affirm that you have legitimately undertaken and completed the corresponding project, internship, coursework, or independent training, OR that you possess the express consent, authority, and approval of your academic mentor, supervisor, institution, or organization to document and seal your skills on this portal.
3. No Impersonation or Identity Fraud: You shall not enter the name, email, or credentials of any third party without lawful written power of attorney. Generating credentials under assumed or fictitious identities is strictly prohibited.

To cover high-performance vector rendering, cryptographic hash calculations, perpetual database registry storage on cloud infrastructure, and 24x7 public QR verification hosting, Elevatifier charges an issuance fee (as visibly stated on checkout, e.g., ₹399 INR or applicable rate inclusive of transaction processing charges).

Prohibition of Frivolous Chargebacks & Payment Disputes

Initiating a bank dispute, payment gateway chargeback, or UPI cancellation after obtaining a certificate is a fraudulent breach of this contract. In the event of any unauthorized, bad-faith, or fraudulent chargeback initiated through Razorpay, banks, or card networks:

• The associated certificate serial number shall be immediately and permanently REVOKED and marked publicly in the registry as "FRAUDULENT / INVALIDATED DUE TO UNPAID CHARGEBACK".
• Elevatifier reserves the unconditional right to recover the disputed transaction fee, bank chargeback penalty fees (minimum ₹1,500 INR), legal processing costs, and liquidated damages.
• Elevatifier reserves the right to report the candidate's name, IP address, and transaction trail to credit bureaus, academic fraud blacklists, and relevant law enforcement cybercrime divisions.

THE ELEVATIFIER WEBSITE, PORTAL ENGINE, CERTIFICATE RENDERER, DATABASE REGISTRY, QR VERIFICATION LINKS, AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, ELEVATIFIER, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, satisfactory quality, fitness for a particular purpose (including academic credit acceptance, employment qualification, or visa sponsorship);
• Warranties that the portal will be uninterrupted, error-free, completely bug-free, or compatible with all devices and third-party browsers;
• Warranties that any prospective employer, recruiter, college faculty, or government bureau will accept, validate, or endorse the certificate.

You acknowledge that whether a certificate is recognized or accepted for academic credit, resume enhancement, or job qualification is entirely at the unilateral discretion of the third party evaluating it, and Elevatifier has zero control over and assumes zero responsibility for such third-party determinations.

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, BREACH OF CONTRACT, OR TORT, SHALL ELEVATIFIER PRIVATE LIMITED, ITS FOUNDER (SHIVANSH VASU), SHAREHOLDERS, DIRECTORS, MANAGERS, EMPLOYEES, CONTRACTORS, SOFTWARE ARCHITECTS, OR PAYMENT PROCESSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

• Any indirect, incidental, consequential, special, punitive, exemplary, or retaliatory damages;
• Loss of academic admission, expulsion, or withholding of university degrees;
• Loss of employment, termination, revocation of job offers, or failure to pass employer background checks;
• Loss of prospective profits, loss of reputation, defamation, or emotional distress;
• Disputes, investigations, or legal actions initiated between you and your college, employer, or government agencies.

You hereby agree to defend, indemnify, and hold completely harmless Elevatifier Private Limited, its founder (Shivansh Vasu), its parent, affiliates, directors, officers, agents, contractors, licensors, service providers, and employees from and against any and all claims, demands, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees, court expenses, and forensic costs) resulting from or arising out of:

1. Your violation or breach of any provision, warranty, or representation contained in these Terms;
2. Your submission of false, fraudulent, manipulated, unauthorized, or infringing data in the certificate generation portal;
3. Your use, presentation, or display of the certificate to any college, university, employer, recruiter, government authority, or public platform;
4. Any claim by a third party (including universities, employers, or legal guardians) asserting that your certificate is unauthorized, fake, or violates their institutional policies;
5. Your violation of any applicable law, rule, regulation, or the rights of any third party.

Elevatifier reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate fully with Elevatifier in asserting any available defenses.

Elevatifier maintains the permanent verification registry accessible at /verify. To maintain the integrity of our infrastructure, Elevatifier reserves the unconditional and unilateral right, exercisable at its sole discretion at any time without prior notice, explanation, or refund:

• Immediate Revocation: To immediately revoke, invalidate, suspend, or permanently remove from the verification registry any certificate ID that is reported or suspected of being based on fraudulent inputs, false claims, unauthorized institutional names, or abusive behavior.
• Status Flagging: To publicly modify the verification status banner on /verify/:id to display "REVOKED", "INVALIDATED FOR BREACH OF TERMS", or "UNDER FRAUD INVESTIGATION".
• Law Enforcement Cooperation: To disclose any transaction records, candidate full names, mobile numbers, email addresses, IP addresses, timestamps, and payment gateway logs to police authorities, cybercrime investigation units, university ethics committees, or court orders upon receipt of lawful summons or requests.

All software architecture, canvas rendering routines, vector badge artwork, gold seal designs, security watermark algorithms, typography compositions, trademarks, and logos displayed on Elevatifier are the exclusive intellectual property of Elevatifier Private Limited and its licensors.

Limited Personal License: Subject to full payment and compliance with these Terms, Elevatifier grants you a revocable, non-exclusive, non-transferable, personal license to download, save, print, and display the single generated certificate for bona fide personal career portfolio purposes and resume presentations.

Prohibitions: You may not reverse engineer, decompile, scrape, modify, sell, resell, or license the underlying certificate graphics, template layouts, verification API endpoints, or QR generation algorithms for commercial resale or creation of competing credential generation tools.

These Terms, the validity thereof, and the relationship between you and Elevatifier shall be governed by, construed, and enforced exclusively in accordance with the substantive laws of the Republic of India, without regard to conflict of law principles.

Mandatory Pre-Litigation Conciliation & Binding Arbitration

In the event of any dispute, controversy, difference, or claim arising out of or relating to these Terms, the certificate portal, or payment processing:

1. Informal Resolution: The parties shall first attempt in good faith to resolve the dispute informally by delivering written notice to contact@elevatifier.com. The notice must specify the full transaction details, certificate serial number, and legal basis of the claim.
2. Arbitration: If the dispute is not settled within thirty (30) calendar days of receipt of such notice, it shall be finally resolved by binding arbitration administered by a Sole Arbitrator appointed mutually by Elevatifier under the Arbitration and Conciliation Act, 1996 (as amended).
3. Seat and Venue: The seat and legal venue of arbitration shall be within India, and all proceedings shall be conducted in the English language. The arbitrator's award shall be final, binding, and enforceable in any court of competent jurisdiction.

Exclusive Court Jurisdiction

Subject to the mandatory arbitration clause above, the competent civil and criminal courts located in the territory of Elevatifier's operational/registered administrative headquarters in India shall have exclusive territorial and subject-matter jurisdiction over any legal proceedings arising out of this Agreement.

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Digital Personal Data Protection Act (DPDPA), 2023, the contact details for official compliance, legal notices, and grievance redressal are provided below:

Severability: If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable by a court or tribunal of competent jurisdiction, then that specific provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Entire Agreement: These Terms, together with our Privacy Policy and verification records, constitute the entire legal agreement between you and Elevatifier concerning the subject matter herein and supersede all prior understandings or agreements.
